These Terms of Service (“Terms”) are an agreement between RetentionFunnel (“RetentionFunnel,” “we,” “us”) and the merchant installing or using the RetentionFunnel app (“Merchant,” “you”) on a Shopify store. By clicking “I Agree and Continue,” or by installing, accessing, or continuing to use RetentionFunnel, the individual accepting on the Merchant’s behalf represents that they are authorized to bind the Merchant, and the Merchant accepts these Terms in full. We record the shop, the date and time, and the version of these Terms accepted, as proof of that acceptance.
RetentionFunnel is a Shopify app that gives Merchants attribution, funnel, and retention reporting for their storefront, using an anonymous, pseudonymous visitor identifier rather than customer-identifying information. See our Privacy Policy for how the service works.
To provide the service, RetentionFunnel collects and uses the following data, and no other data:
RetentionFunnel does not request, receive, or store the end customer’s name, email address, phone number, shipping or billing address, or payment details. RetentionFunnel has not requested Shopify’s protected customer fields (name, email, phone, address) and does not need them to identify a repeat customer: repeat-visit and repeat-purchase detection is done entirely through the anonymous browser identifier described above.

Because RetentionFunnel operates on data you control as the merchant of record for your store, and does not itself collect end-customer names, emails, phone numbers, or addresses, you, the Merchant, assume all liability for, and agree to indemnify and hold harmless RetentionFunnel, its owners, and operators from, any claim, challenge, inquiry, complaint, or legal proceeding brought by an end customer, a regulator, or any other third party arising out of or relating to your store’s data practices, your disclosures (or lack of disclosure) to your customers, or your use of RetentionFunnel, including but not limited to claims relating to data collection, use, retention, or deletion. This includes your reasonable costs of defending such a claim, including attorneys’ fees. This section does not limit any right you may have against RetentionFunnel for RetentionFunnel’s own breach of these Terms or of applicable law.
RetentionFunnel is billed on a usage basis through Shopify, as described in the app’s pricing and in your Shopify billing. See the Billing page inside the app for your current rate and cap.

RetentionFunnel is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or fully accurate.
To the maximum extent permitted by law, RetentionFunnel will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of the service. RetentionFunnel’s total liability for any claim arising out of these Terms will not exceed the fees you paid RetentionFunnel in the three months preceding the claim.
These Terms apply for as long as you have RetentionFunnel installed. Either party may end this agreement at any time by uninstalling the app (Merchant) or by disabling the app’s access to your store (RetentionFunnel, for cause, such as a violation of these Terms). Sections 5, 8, and 9 survive termination.
We may update these Terms from time to time. When we do, we will update the “Last updated” date and version above, and Merchants will be asked to re-accept the new version the next time they open the app. Continued use after acceptance of a new version constitutes agreement to it.
These Terms are governed by the laws of [GOVERNING LAW / JURISDICTION — TO BE COMPLETED], without regard to conflict-of-laws principles.

When you accept these Terms in the app, we record your shop’s domain, the date and time, the version of these Terms accepted, and, where available from your Shopify staff session, the email of the person who accepted — as proof that the Merchant agreed to these Terms and to RetentionFunnel’s data practices described above.
